Abbott Tries To Nix Amended HIV Drug Price Suits

Law360, New York (September 11, 2009, 3:26 PM ET) -- Abbott Laboratories has asked a judge to throw out four recently amended complaints filed by pharmacies, wholesale direct drug purchasers and rival drug manufacturers alleging Abbott illegally jacked up the prices of its market-dominating HIV drugs, calling the complaints “a vain attempt to plead around” recent antitrust case law.

Rite Aid Corp., Meijer Inc., Safeway Inc., GlaxoSmithKline PLC and the other plaintiffs have not alleged any form of exclusionary conduct, the central element in any monopolization claim, according to Abbott's motion, filed Thursday in the U.S....
