Law360, New York (October 15, 2009, 2:49 PM ET) -- The federal judge overseeing LG Electronics USA Inc.'s suit alleging Whirlpool Corp.'s false advertising regarding steam-powered dryers hurt sales of LG's products has ordered the defendant to produce documents containing communications with its advertising agencies.
U.S. District Judge Amy St. Eve of the Northern District of Illinois said in an opinion Tuesday that Whirlpool cannot rely on the de facto employee test or the “common legal interest” exception to justify including the documents in its privilege log.
