Pharmaceutical Giants, Consumers Spar As Trial Looms

Law360, New York (November 03, 2006, 12:00 AM ET) -- On the eve of trial, a federal judge has clarified the definition of a term at the center of an antitrust class action lawsuit alleging that a slew of pharmaceutical companies defrauded consumers by artificially inflating the prices of various prescription drugs.

The ruling, handed down by U.S. District Judge Patti B. Saris in the U.S. District Court of Massachusetts, was issued in a complex consolidated case in which the drug makers stand accused of pumping up the Average Wholesale Price (AWP) for certain drugs....
