BP, Others Try To Escape Drug Test Antitrust Action

Law360, New York (November 18, 2009, 4:15 PM ET) -- BP America Inc., ConocoPhillips Co., Shell Exploration & Production Co. and other energy companies have told a federal judge that there is no reason for them to be targeted in a putative class action brought by employment drug screening firms alleging that DrugTest Inc. snuffed out competition for oil and gas industry clients.

The energy companies filed a motion Tuesday in the U.S. District Court for the District of Colorado that they be dismissed from the case, contending that the plaintiffs’ assertions are “nonsensical.”
