Judge Lets Antitrust Case Against Realtors Proceed

Law360, New York (November 28, 2006, 12:00 AM ET) -- A federal judge in Illinois has denied a motion by the National Association of Realtors to dismiss a far-reaching antitrust case brought last year by the U.S. Department of Justice.

The U.S. District Court in Chicago issued a 29-page opinion Monday allowing the case to proceed, rejecting NAR's argument that last-minute changes to its policies prevented judicial scrutiny, the DOJ said.

“NAR has failed, with all respect, to demonstrate that this case should be dismissed at the outset,” the court wrote in its opinion.
