Law360, New York (December 01, 2006, 12:00 AM ET) -- In a blow to the Federal Communications Commission, a U.S. appeals court has tossed the agency’s 2004 decision that local telephone carrier BellSouth Corp. discriminated against competitors by offering various network access discounts.
On Friday, the U.S. Court of Appeals for the District of Columbia overturned the FCC ruling, finding the Commission’s explanation for its earlier action to be “wanting,” according to court documents.
