NY Claims Stand In AWP Drug MDL

Law360, New York (January 28, 2010, 1:15 PM ET) -- A federal judge has killed a bid to throw out claims by New York City and 42 New York counties in multidistrict litigation alleging major pharmaceutical companies jacked up the average wholesale price of their drugs sold through the state's Medicaid drug benefit program.

Judge Patty B. Saris of the U.S. District Court for the District of Massachusetts on Wednesday granted the New York plaintiffs' motion for partial summary judgment and denied the defendants' bid for the same.
