On The Brink Of New Horizontal Merger Guidelines

Law360, New York (February 16, 2010, 1:22 PM ET) -- There is little doubt that an update is imminent for the Horizontal Merger Guidelines used by the Federal Trade Commission and the Antitrust Division of the U.S. Department of Justice in evaluating mergers and acquisitions involving competitors.

On Sept. 22, 2009, the FTC and the Antitrust Division announced their intent to examine whether the Guidelines should be updated.[1] The plan called for an assessment of the Guidelines through public comment and workshops held throughout the nation.
