Best Buy Moves To Dismiss False Ad Class Action

Law360, New York (March 12, 2010, 6:19 PM ET) -- Best Buy Stores LP has told a federal judge that a putative class action accusing the retailer of failing to abide by its advertised price-match contract does not state a claim for relief, despite having been amended twice.

Best Buy's motion to dismiss the lawsuit, filed Thursday in the U.S. District Court for the Central District of California, said named plaintiffs Duc Truong, Horst Simon and Clarissa Padilla have asserted "vague and conclusory allegations" and have merely paraphrased company policy.
