Law360, New York (April 21, 2010, 5:07 PM ET) -- A federal judge is standing by a decision to cleave off and stay Philips Electronic North America Corp.'s antitrust counterclaims in an infringement suit brought by Masimo Corp. over pulse oximeter patents.
Philips' arguments for reconsideration did not persuade her to change her mind, Judge Mary Pat Thynge of the U.S. District Court for the District of Delaware said Monday.
Sued by Masimo for allegedly infringing several patents, Philips shot back with accusations that Masimo has unfairly monopolized the pulse oximeter market.
