Class Cert. Stands In Canadian Peroxide Antitrust Suit

Law360, New York (June 14, 2010, 5:52 PM ET) -- An Ontario judge has refused to allow Arkema Canada Inc. and FMC Corp. to appeal an order certifying a class of direct and indirect purchasers in a price-fixing suit against the hydrogen peroxide makers.

Justice Lynne C. Leitch of the Ontario Divisional Court ruled June 8 that the plaintiffs, led by Irving Paper Ltd. and including indirect purchasers of paper and other products, had offered a "credible and plausible methodology" to show damage on a classwide basis.
