Law360, New York (July 08, 2010, 1:01 PM ET) -- C&S Grocers Inc. and SuperValu Inc., two of the country's largest grocery wholesalers, have lost their bid to toss an antitrust suit alleging they engaged in a conspiracy to inflate prices by entering into a noncompete agreement.
Judge Ann Montgomery of the U.S. District Court for the District of Minnesota on Wednesday denied a motion by C&S and SuperValu to dismiss the suit, though she also denied a motion by plaintiffs including Blue Goose Super Market Inc. and Prather's IGA for summary judgment.
