Law360, New York (July 27, 2010, 4:36 PM ET) -- Citing flaws in the agreement, a judge has refused to approve a $4.2 million settlement between indirect purchasers of hydrogen peroxide and FMC Corp., Arkema Inc. and other companies in the multidistrict litigation over alleged price-fixing in the industry.
The motion to approve the agreement contains too many deficiencies to greenlight in its current form, Judge Stewart Dalzell said in the U.S. District Court for the Eastern District of Pennsylvania on Monday.
