EU Lays Down The Gauntlet On Information Exchanges

Law360, New York (October 06, 2010, 12:36 PM ET) -- Earlier this year, the European Commission published a set of draft horizontal guidelines, which apply to agreements and “concerted practices” between competing companies. These draft antitrust guidelines, which ordinarily will be adopted and enter into force in January 2011, seek to expand the commission’s power to fine companies for their participation in so-called “information exchanges,” a form of cartel under EU competition law.
