9th Circ. Nixes IPhone Antitrust Class Cert. Appeal

Law360, New York (October 19, 2010, 4:16 PM ET) -- Apple Inc. and AT&T Mobility LLC have lost their bid to appeal class certification in an antitrust suit accusing the technology companies of monopolizing the aftermarket for iPhone voice and data services.

Circuit Judges Diarmuid F. O'Scannlain and William A. Fletcher issued a one-page order in the U.S. Court of Appeals for the Ninth Circuit on Tuesday denying the companies' petition to appeal the U.S. District Court for the Northern District of California's decision certifying the class.
