EU To Sue Italy Over Alcoa Power Subsidies

Law360, New York (March 23, 2011, 3:37 PM ET) -- The European Commission said Wednesday it planned to take Italy to court for failing to recover €295 million ($418 million) in alleged state aid that it provided to Alcoa Inc. in preferential electricity tariffs.

The commission found in November 2009 that the tariffs were unlawful state aid because they gave Alcoa an unfair advantage over competitors, and it ordered Italy to partially recover the subsidies.

But Italian authorities have not yet recovered the aid, so the commission has decided to refer Italy to the European Court...
