Law360, New York (April 28, 2011, 6:56 PM ET) -- The European Union's antitrust watchdog said Thursday it had launched a formal probe of U.S. pharmaceutical giant Cephalon Inc.’s alleged attempt to pay Teva Pharmaceutical Industries Ltd. to keep a generic version of narcolepsy drug Provigil off the market.
The European Commission said it would investigate whether Cephalon’s 2005 settlement with Israel-based Teva to halt its plans to produce Modafinil — the generic version of Provigil — was a pay-for-delay tactic to keep the drug from entering the European pharmaceutical market.
