Animal DNA Co. Can't Shake Testing Patent Suit

Law360, New York (May 24, 2011, 2:25 PM ET) -- A New York federal judge on Monday refused to toss an infringement and unfair competition suit OptiGen LLC filed against Animal Genetics Inc. over canine DNA testing technology, threatening to sanction Animal Genetics' counsel for his overzealous sanctions requests.

OptiGen sued Animal Genetics in August, alleging its method of testing dog DNA for progressive rod-cone disease, a hereditary eye disease that can cause blindness, infringes two patents for which it holds an exclusive license. Like OptiGen, Animal Genetics provides mail-based animal DNA diagnostic services.
