Law360, New York (June 02, 2011, 1:58 PM ET) -- The Seventh Circuit on May 26 affirmed the dismissal of an antitrust suit against the Chicago-area Lake Forest Hospital, holding that the hospital's lobbying against the building of another company's new medical facility was protected by the First Amendment.
Plaintiff Mercatus Group LLC claimed that the hospital was seeking to monopolize the market for physician services and medical imaging centers by encouraging a village board to deny Mercatus permission to build its facility.
