Law360, New York (July 06, 2011, 8:13 PM ET) -- A California company formed to sell Stryker Spine products filed a lawsuit in federal court Tuesday to get the spine implant maker to back off a noncompete deal preventing it from partnering with DePuy Spine Inc.
BioInitiatives Inc. said in the suit that its agreement to sell Stryker products had expired and that enforcement of the noncompete provision constitutes an anticompetitive business practice under California law. The medical device sales company and DePuy sued Stryker to get the agreement deemed invalid.
