German Court Rejects Ban On New Samsung Tablet

Law360, New York (February 09, 2012, 2:01 PM ET) -- Another German court on Thursday refused to ban sales of a Samsung Electronics Co. tablet, finding changes in the design of Samsung’s newest tablet prevent it from infringing Apple’s patents or violating the country’s competition laws.

The Dusseldorf Regional Court echoed an earlier decision by a Munich court to deny Apple’s motion for a preliminary injunction against Samsung’s Galaxy Tab 10.1N tablet. Samsung's tablet was distinct enough from Apple’s products that it did not infringe Apple’s European community design patents, the Dusseldorf court said in a statement....
