Law360, New York (April 06, 2012, 8:12 PM ET) -- A New Jersey federal judge on Thursday tossed a putative class action by consumers against magnesium oxide companies accused of a price-fixing conspiracy, but allowed an amended complaint filed by a group of direct purchasers to stand.
In proving their reliance on the magnesium oxide producers for price information and naming instances where the companies' rate hike justifications veiled the alleged conspiracy, the direct purchasers satisfied the court's standards for lifting the statute of limitations, U.S. District Judge Dickinson R.
