Indirect Purchasers' Claims Cut In Compressor Antitrust MDL

Law360, New York (June 07, 2012, 11:22 PM ET) -- A Michigan federal judge on Thursday dismissed most of the indirect purchaser plaintiffs' claims in multidistrict litigation alleging a price-fixing conspiracy in the market for refrigerant compressors.

U.S. District Judge Sean F. Cox tossed all the indirect purchasers' claims except for those aimed at Panasonic Corp. and Whirlpool Corp. subsidiary Embraco North America Inc. The plaintiffs failed to state a claim under the heightened pleading standard required by the U.S. Supreme Court's ruling in Bell Atlantic Corp. v. Twombly, according to the judge.
