Law360, New York (July 10, 2012, 5:17 PM ET) -- A Lehigh County, Pa., paving company on Monday asked a federal judge to toss a competitor’s antitrust suit accusing it of colluding with several towns to win lucrative roadwork contracts, saying its lobbying actions were protected by prior case law.
Asphalt Maintenance Services LLC was sued by competitor Asphalt Paving Solutions Inc. in May. APS claims that AMS convinced seven southeastern Pennsylvania towns to write bid specifications for road paving contracts that included equipment and supplies only available to AMS.
