Zurich, Amerisure Avoid Tab In Cement Cos.' Antitrust Suits

Law360, New York (August 03, 2012, 4:48 PM ET) -- A New York federal judge on Friday tossed three cement companies' claims against Zurich Insurance Co. Ltd. and Amerisure Insurance Co. seeking defense costs for underlying antitrust class actions, saying their policies did not cover allegations that they lied about a price-fixing scheme.

U.S. District Judge Louis L. Stanton awarded the insurers summary judgment and dismissed the case with prejudice, finding that the policies covering liability for inflicting “personal and advertising injury” did not apply to the underlying actions.
