Law360, New York (October 17, 2012, 5:08 PM ET) -- Stores won't violate federal kickback laws by including copayments for prescription drugs covered by government health programs in a rewards program where customers earn gas discounts based on how much they spend, the U.S. Department of Health and Human Services' watchdog said Tuesday.
The Office of Inspector General issued the advisory opinion in response to an unnamed supermarket chain concerned that including the drug copays in its rewards program would constitute an illegal kickback, exposing it to civil monetary penalties.
