Law360, New York (October 19, 2012, 8:09 PM ET) -- An evenly divided en banc Eleventh Circuit on Friday upheld a ruling that found 21 hedge funds didn't violate antitrust laws by allegedly conspiring to force CompuCredit Holdings Corp. to redeem the credit provider's bonds ahead of schedule.
With a 5-5 split, the appeals court's decision effectively wipes out the reasoning of the most recent ruling by a three-judge panel of the appeals court, which affirmed the district court ruling in Georgia's Northern District, and leaves the district court decision intact.
