U.S. Says It Need Not Produce Docs In AWP Case

Law360, New York (November 05, 2007, 12:00 AM ET) -- In a government action against the major drug companies over an alleged Medicare scam, the U.S. on Friday defended its right to keep secret records explaining the rationale for relying on the industry's own prices.

In October, drug manufacturer Abbott Laboratories Inc. urged the Massachusetts judge overseeing the multidistrict litigation over the industry's average wholesale drug prices to compel the government to turn over documents detailing its decision to adopt, and keep, the reported prices as the basis for Medicare rebates on prescription medication.
