Law360, New York (January 07, 2008, 12:00 AM ET) -- An effort to force the National Association for Stock Car Auto Racing and the International Speedway Corp. to bring an elite Nextel Cup race to the Kentucky Speedway has failed, as a judge dismissed the lawsuit on Monday.
Judge William O. Bertelsman of the U.S. District Court for the Eastern District of Kentucky closed the case after granting motions by the defendants to exclude expert testimony and grant summary judgment in the suit.
