Wisconsin's Fee Award In AWP Litigation Reversed

Law360, New York (February 04, 2008, 12:00 AM ET) -- Wisconsin has suffered a blow in its case against Dey Inc. and others over average wholesale prices of pharmaceuticals, with an appeals court reversing the state's fee award and shooting down its request to award sanctions.

The ruling, handed down Monday by a three-judge panel of the U.S. Court of Appeals for the Seventh Circuit, reversed an order awarding Wisconsin $14,208 in attorneys' fees and costs that it incurred in getting the case remanded from federal to state court.
