West, Kaplan Face New Suit Over Bar Prep Courses

Law360, New York (February 08, 2008, 12:00 AM ET) -- West Publishing Corp. and Kaplan Inc. are facing another class action antitrust lawsuit for alleged collusion in the bar exam test preparation businesses. They reached a settlement agreement of $49 million for a similar suit last year.

The plaintiffs allege that executives of Kaplan and West, doing business as BAR/BRI, secretly agreed that Kaplan would stay out of the lucrative bar review course market in exchange for BAR/BRI's payments to the company, according to class plaintiffs' attorney Eliot Disner of the Disner Law Corp.
