Law360, New York (December 12, 2008, 12:00 AM ET) -- A federal judge has allowed AT&T Kentucky to keep some of its claims alive in a rate dispute that involves an interconnection agreement enabling SouthEast Telephone Inc. to compete as a local carrier.
Judge Danny C. Reeves of the U.S. District Court for the Eastern District of Kentucky ruled on Wednesday that AT&T could continue to bring claims contesting a May order by the Kentucky Public Service Commission in favor of SouthEast, but struck down AT&T’s breach of contract claim based on res judicata.
