Wells Fargo Techies Win Conditional Cert. In FLSA Suit

Law360, New York (October 27, 2009, 6:57 PM ET) -- Technical support workers for Wells Fargo & Co. have secured conditional certification in a wage-and-hour action alleging that the bank violated the Fair Labor Standards Act by misclassifying the employees as exempt from overtime pay.

Judge Claudia Wilken of the U.S. District Court for the Northern District of California issued an order Monday granting the three named plaintiffs' request for certification of the case as a collective action.
