6th Circ. Sides With TRW In Retirees’ Benefits Case

Law360, New York (November 04, 2009, 3:01 PM ET) -- A federal appeals court has upheld the dismissal of a proposed class action brought by TRW Automotive US LLC retirees accusing the auto parts supplier of breaching an agreement to provide lifetime medical benefits.

The U.S. Court of Appeals for the Sixth Circuit on Tuesday affirmed a district court’s finding that a collective bargaining agreement unambiguously disclaimed the company’s obligation to provide lifetime health coverage to retirees and that a subsequent plant shutdown agreement did not extend the plaintiffs’ rights or replace the CBA.
