Law360, New York (February 04, 2010, 1:59 PM ET) -- A delivery driver who sued DHL Express (USA) Inc. has lost his bid for class certification of a state law claim that he and others were misclassified as exempt and wrongly denied overtime pay.
Judge Barbara B. Crabb denied the petition for class certification because questions of law common to the class did not predominate over issues affecting the individual members, according to her ruling, filed Wednesday in the U.S. District Court for the Western District of Wisconsin.
