Ex-Fieldstone GC's Whistleblower Suit Thrown Out

Law360, New York (March 18, 2010, 4:42 PM ET) -- A judge has dismissed a retaliation suit filed by Fieldstone Investment Corp.'s former general counsel Cynthia L. Harkness, saying the in-house attorney's actions were not shielded under the whistleblower provisions of the Sarbanes-Oxley Act.

Judge Catherine C. Blake of the U.S. District for the District of Maryland ruled Tuesday that Harkness was not protected under SOX when she reported CEO Michael Sonnenfeld to Fieldstone's audit committee for disclosing inside information to an outside investor, which Harkness claimed led to her termination from the company in 2006....
