Wells Fargo Fights Class Cert. In FLSA, ERISA Suit

Law360, New York (March 19, 2010, 2:37 PM ET) -- Wells Fargo Bank NA is fighting a bid to certify a class of current and former technical support workers who claim they have been misclassified as exempt from overtime pay and denied retirement benefits.

The bank filed an opposition brief Thursday in the U.S. District Court for the Northern District of California claiming the proposed job classifications and duties were too different to support proceeding on a classwide basis.
