Law360, New York (April 29, 2010, 2:30 PM ET) -- A federal judge has tossed a class action accusing Unisys Corp. and Fidelity Management Trust Co. of breaching fiduciary duties by forcing pension plan participants to pay higher fees in violation of the Employee Retirement Income Security Act.
Judge Berle M. Schiller of the U.S. District Court for the Eastern District of Pennsylvania on Monday granted separate dismissal motions from Unisys and Fidelity, ruling that Unisys did not breach its duty and Fidelity was not a fiduciary under ERISA.
