9th Circ. Affirms Class Denial In Starbucks OT Suit

Law360, New York (May 05, 2010, 7:12 PM ET) -- A federal appeals court has upheld the denial of class certification to a group of former Starbucks Corp. employees claiming the coffee giant failed to pay them for off-the-clock work in violation of California's Labor Code.

The district court did not abuse its discretion when it ruled that individualized factual determinations would be required to adjudicate claims, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit ruled Wednesday.
