DC Circ. Revives Hospital Race Bias Class Action

Law360, New York (June 02, 2010, 12:44 PM ET) -- A federal appeals court has revived a class action asserting George Washington University Hospital discriminated against black nursing assistants, saying the fact that not all plaintiffs filed a complaint with the U.S. Equal Employment Opportunity Commission was no reason to dismiss.

The district court improperly held that plaintiff-appellants Monica Brooks and Tracee Taylor did not exhaust their administrative remedies, a three-judge panel in the U.S. Court of Appeals for the District of Columbia Circuit ruled Tuesday.
