Citizens Bank Workers Win Class Cert. In OT Fight

Law360, New York (September 03, 2010, 2:27 PM ET) -- Assistant branch managers suing Citizens Financial Group Inc. for overtime pay have received conditional class certification, opening the case to thousands of opt-in plaintiffs in all nine states where the bank has retail branches.

On Thursday, Judge Gary Lancaster of the U.S. District Court for the Western District of Pennsylvania approved a representative class of assistant bank managers, discounting Citizens’ contention that collective certification is unsuitable because individual branches are responsible for any departure from the lawful company policies.
