7th Circ. Sides With Chicago Fire Dept. In Labor Spat

Law360, New York (January 06, 2011, 4:05 PM ET) -- The Seventh Circuit has ruled that the Chicago Fire Department did not discriminate when it failed to promote a black ambulance commander, even though he had been in line for advancement under a scrapped promotion system.

In an opinion by Circuit Judge Richard Posner, the U.S. Court of Appeals for the Seventh Circuit on Tuesday rejected Gregory Stinnett’s argument that the city of Chicago discriminated against him when the fire department stopped filling vacancies for field officers from the promotion list it had eliminated.
