Law360, New York (March 23, 2011, 6:42 PM ET) -- The Ninth Circuit refused on Wednesday to lift its order effectively barring same-sex marriages in California while it mulls the constitutionality of a state proposition that banned gay marriage, despite California Attorney General Kamala D. Harris' opposition to the ban.
The U.S. Court of Appeals for the Ninth Circuit opted not to lift a stay on a district court's ruling that the 2008 California ballot initiative that banned gay marriage was unconstitutional. The stay allows the government to enforce Proposition 8.
