Law360, New York (August 10, 2011, 4:56 PM ET) -- The Eighth Circuit ruled Wednesday that an early retirement incentive plan that reduced benefits to a putative class of Minnesota Department of Corrections employees older than 55 violated the Age Discrimination in Employment Act.
Affirming a Minnesota court's ruling of summary judgment, the appeals court concluded that the Minnesota Law Enforcement Association's retirement plan arbitrarily discriminated against older employees on the basis of age.
