Social Workers Not Exempt From OT Under FLSA: 9th Circ.

Law360, New York (September 09, 2011, 5:32 PM ET) -- The Ninth Circuit on Friday resurrected a U.S. Department of Labor suit against Washington state's Department of Social and Health Services, saying social workers are not “learned professionals” exempted from federal overtime pay laws.

The DOL sued the DSHS in July 2008, seeking recovery of unpaid compensation for case-carrying social workers the agency claimed had not been paid for overtime work in accordance with the Fair Labor Standards Act.
