Understaffed NLRB Passes Litigation Reins To GC

Law360, New York (November 09, 2011, 3:37 PM ET) -- The National Labor Relations Board has implemented a new policy that delegates to its general counsel authority over litigation matters that the NLRB will not be allowed to address once its membership drops to two at the end of the year, the agency announced Wednesday.

With board member Craig Becker’s term set to expire in December, the labor agency said the new policy would allow its general counselor to take the reins of the understaffed NLRB, thereby allowing the board to continue operating in 2012....
