Lowe's Wrongly Dropped Employees' Health Plans: Suit

Law360, New York (February 03, 2012, 6:50 PM ET) -- Home improvement retailer Lowe’s Cos. Inc. faces a putative class action claiming it wrongfully terminated health care benefits for its employees for all or part of 2011, attorneys for the plaintiffs said Friday.

The suit, lodged in New York federal court, claims Lowe’s breached its fiduciary duties under the Employee Retirement Income Security Act when it changed its annual re-enrollment requirements in its group health plan in 2010 and didn’t properly inform its employees, causing many to lose their coverage.
