Law360, New York (May 14, 2012, 7:17 PM ET) -- An Indiana diocese told a federal court Monday that a former Catholic school teacher's lawsuit alleging she was wrongly fired after undergoing in vitro fertilization is barred by the ministerial exception to employment discrimination laws.
English teacher Emily Herx in April alleged that the Diocese of Fort Wayne-South Bend and the St. Vincent de Paul School where she taught violated the Americans with Disabilities Act and Title VII by firing her for using the fertility treatments.
