Law360, San Diego (May 24, 2012, 6:19 PM ET) -- A financial adviser who was turned down for a job with Bank of America Corp. filed a proposed class action in California federal court Wednesday, alleging the bank’s hiring practices discriminate against older workers.
Gary Ernst, whom the complaint describes as a “57-year-old gentleman with excellent experience as a financial adviser,” claims BofA violated the Age Discrimination in Employment Act by passing him over for a job despite his clear qualifications.
