Noncompetes: A New Argument For Texas Employers

Law360, New York (July 02, 2012, 12:47 PM ET) -- The Supreme Court of Texas has looked at Section 15.50(a) of the Texas Business & Commerce Code three times in the past half dozen years. Each time the court has made it easier for employers to enforce covenants not to compete.

Conventional wisdom says that in the future, the focus of litigation will usually be on whether the limitations as to time, geographical area and scope of activity contained in the covenant are reasonable. That is probably correct.
